Last Will and Testament

Mae J. Diggle
I Mae Josephine Diggle, residing at 1234 Macaroon Way, City of South Rochester, County of Rochester, State of Georgia, being of sound mind and disposing mind and memory, and not acting under undue influence of any person whomsoever, make, publish, and declare this document to be my last will and testament, and expressly revoke any prior wills and codicils, made by me.
Article I
I direct my personal representative hereinafter named, to pay all my legally enforceable debts, and expenses of my last illness, funeral, burial, and estate administration out of the residue of my estate. I further direct my personal representative to pay out of my residuary estate all estate, income, and inheritance taxes assessed against my taxable estate or the recipients thereof, whether passing by this will or by other means, without contribution or reimbursement from any person.
Article II
I give my bone china tea set, which I own to my sister Kelly Foxworth, if she should survive me.
Article IV
I give $10,000.00 to my dear friend Gloria Wagner.
Article V
I give the rest and remainder of my estate, real, personal, or mixed, of whatever kind and wherever located , after the payment of debts, expenses, and taxes, as mentioned in Article I, subject to the laws, to be divided equally between my two children, Robert Diggle, and Carolyn Diggle. I wish for my grandchildren to inherit from a parent under per stirpes.
Article VI
I nominate and appoint my two children, Robert Diggle and Caroline Diggle to act as co –personal representatives of this will, and to serve without bond. If either personal representative predeceases me, declines to serve, or does not qualify as personal representative, I nominate the other to serve as my sole personal representative. My personal representative shall have the power to sell publicly or privately all or part of the residue of my property in the event that such sale will become necessary for the payment of debts, taxes, or expenses, until the testamentary dispositions thereof are complete; and to settle all valid claims against my estate.
ARTICLE VII
I freely and willingly subscribe my name to this will consisting of two pages, including this page, on this of , 20 , in the presence of these witnesses: John Doe and Jane Doe, each of whom I have requested to subscribe their names in my presence and in the presence of all others. (Signature)
On the last date shown above, Mae J. Diggle, known to us to be the person whose signature appears at the end of this will, declared to us, the undersigned, that the foregoing instrument was his will. He then signed the will in our presence; at his request, we now sign our names in his presence and the presence of each other.
