The Diggle Estate
1. Mae Josephine Diggle is your client. She is widowed and has two children and one grandchild. She wants to leave her best friend, Gloria Wagner, $10,000. She wants to leave her sister, Kelly Foxworth, her bone china tea set, but only if she survives her; otherwise the tea set would go to her niece, Samantha Foxworth. She leaves the remainder of the estate to her two children, Robert Diggle, age forty, and Carolyn Diggle, age thirty, in equal shares. Mae wants any grandchildren to inherit from a parent under per stirpes. Mae wants her two children, Robert and Carolyn, to serve as coexecutors. Waive bond. Draft a simple will with a self-proving affidavit (see Chapter 4).
2. Mae has executed her prior will, but now she wants some small adjustments to be made. She has decided not to leave the $10,000 to Gloria Wagner. They had a falling out and Gloria is no longer Mae’s friend. Mae wants to leave all her cookbooks to the local library. Draft a codicil indicating these changes.
3. Mae has decided to travel to Europe for six months and is trying to sell her summer cottage. Prepare a limited power of attorney nominating her son, Robert Diggle, as the agent.
4. Mae wants a durable power of attorney created. She wants her son, Robert Diggle to be her agent and to be her guardian if it becomes necessary. She wants Robert to be granted a wide variety of the standard powers that are usually given to an agent for a power of attorney (see Chapter 3).
5. Mae is feeling fine; however if she becomes terminally ill, she does not want to be resuscitated. She does not want any experimental drugs used, but she does want nutrition and hydration to be continued. Prepare a living will. (See Chapter 3).
